Selling a rental property while tenants are still living in it is something many Essex landlords face at some point. Whether you are looking to exit the market, release equity, or simply move on, it is perfectly legal to sell a tenanted property. But it does come with extra steps and decisions that a standard sale does not.
 

Can You Sell With Tenants in Place?

Yes. You can sell a tenanted property in England at any time. The sale does not end the tenancy. If you sell with a tenant still in residence, the new owner becomes their landlord and must honour the existing tenancy agreement, including the rent level and deposit obligations.
 

What the Renters' Rights Act 2025 Changes

The Renters' Rights Act 2025 came into force on 1 May 2026 and removed the right to use Section 21 "no fault" evictions. If you want your tenant to leave before you sell, you must now serve a Section 8 notice using Ground 1A, which covers a landlord's intention to sell.

The key rules under Ground 1A are:

  • You cannot use it until the tenancy has been in place for at least 12 months

  • You must give your tenant a minimum of 4 months' notice

  • If the tenant does not leave, you will need to apply to court for a possession order

Selling in situ works well when your tenant pays at or above the market rent and you want to avoid the delay of a notice period. Vacant possession gives you access to a wider buyer pool and usually a higher price.

Practical Tips for a Smooth Sale

Talk to your tenant early and honestly. Tenants who feel respected are far more likely to cooperate with viewings and keep the property presentable. You must give at least 24 hours' written notice before entering the property for any purpose.

Also check that the deposit is protected in a government-approved scheme before you proceed. Courts can refuse possession orders where this has not been done correctly, and the obligation transfers to the new owner on completion.
